Terms of Service

Effective Date: 7 June 2025

Welcome to Foundations (“we”, “our”, or “us”), a software platform operated by Michael Dominic van Almsick as a sole trader based in the United Kingdom. These Terms govern your access to and use of the Foundations website and services at usefoundations.app (“Service”). If you do not agree to these Terms, you must not use the Service.

1. Who We Serve

Foundations is designed for personal trainers, therapists, life coaches, nutritionists, private tutors, and other professionals who work one-to-one with clients. You must be at least 18 years old and able to form a legally binding contract to use the Service.

2. Your Responsibilities

You agree to:

  • Provide accurate account and payment information;
  • Maintain the security of your login credentials;
  • Comply with all applicable laws and regulations when using the Service;
  • Only store data (e.g. client notes) that you are legally allowed to handle.

You must not:

  • Upload or transmit unlawful, harmful, or infringing content;
  • Attempt to reverse-engineer, disrupt, or compromise the Service;
  • Use the Service for any purpose other than its intended use.

3. Payments

All payments and payouts are processed through Stripe. Foundations may charge a platform fee (currently 0.3%) on each transaction you process via Stripe. This fee is included in the payment total but is not itemised separately to the client at checkout. Stripe also charges a separate processing fee, which as of this writing is typically 1.5% + 20p for UK card payments. These fees are deducted before funds are paid out to you. You are responsible for completing the Stripe Connect onboarding flow in order to receive payouts.

4. Account Suspension or Termination

We reserve the right to suspend or terminate your account, or restrict access to the Service, at our sole discretion for any violation of these Terms or if required by law. You may cancel your account at any time by emailing support@usefoundations.app.

5. Intellectual Property

All intellectual property rights in the Service — including software code, design, branding, and logos — are owned by Michael Dominic van Almsick. You may not reproduce, copy, or modify any part of the Service without prior written consent.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of any data you upload. You grant us a limited licence to process that data solely to operate and improve the Service.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page or communicated via email. Continued use of the Service after changes take effect constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be resolved exclusively in the courts of England and Wales.
